Welcome to Menzili.tn, an online platform dedicated to the publication, consultation and facilitation of contact between users in the real estate sector in Tunisia.

Access to and use of Menzili.tn implies full acceptance of these Terms and Conditions of Use (“Terms”).

If you do not agree to these Terms, you must refrain from using the website and its services.

1. Definitions

For the purposes of these Terms:

Menzili refers to the real estate platform available, in particular, at https://www.menzili.tn/.

User means any person browsing or using the website.

Member means any User with an account on Menzili.

Advertiser means any Member who publishes a real estate listing on the platform.

Individual means a person using Menzili for personal purposes.

Agency means a real estate agency or professional using Menzili in connection with its business activity.

Listing means any real estate content published on the platform, including information, text, photographs and other elements relating to a property.

2. Purpose of the Platform

Menzili allows users to:

• search for and browse real estate properties;
• publish real estate listings;
• view listings published by individuals and professionals;
• view real estate agencies present on the platform;
• facilitate contact between advertisers and people interested in properties;
• access free or paid services offered to advertisers, depending on the available offers.

Menzili primarily operates as a real estate listing and connection platform.

Unless expressly stated otherwise, Menzili is not a party to transactions concluded between users, including sales, rentals, mandates or other real estate transactions.

3. Acceptance of the Terms

Any use of Menzili constitutes acceptance of these Terms.

When creating an account, publishing a listing or using a service requiring registration, the User acknowledges having read and accepted these Terms.

Menzili may modify these Terms at any time to reflect changes to its services, operations or applicable regulations.

The applicable version is the version published on the website on the date the service is used.

4. Website Access

Menzili makes reasonable efforts to keep the platform accessible under normal conditions.

However, access to the website may be temporarily interrupted, particularly due to:

• maintenance operations;
• updates;
• technical issues;
• hosting or network problems;
• events beyond Menzili's control.

Menzili does not guarantee permanent or uninterrupted availability of the website.

5. Account Creation and Use

Certain features require the creation of an account.

The User agrees to provide accurate, complete and up-to-date information when registering.

The User is responsible for maintaining the confidentiality of their login credentials and for all activity carried out through their account.

The User must notify Menzili as soon as possible if they become aware of any unauthorized use of their account.

An account is personal and must not be used to impersonate another person or organization.

Menzili may request additional information or documents when necessary to verify an account or activity.

6. Publishing Listings

The Advertiser is solely responsible for the content and accuracy of the information published in their listings.

Each listing must:

• relate to a real property;
• contain accurate and sufficiently precise information;
• be published in the appropriate category;
• concern a property located in the stated geographical area;
• comply with applicable laws and regulations;
• not contain misleading or fraudulent information.

The Advertiser must update a listing when information relating to the property changes.

When a property is sold, rented or no longer available, the Advertiser must, depending on the features offered by Menzili, update its status or remove the listing.

7. Prohibited Content

Users are prohibited from publishing on Menzili:

• fictitious or fraudulent listings;
• intentionally false or misleading information;
• properties that the Advertiser is not authorized to offer;
• content that infringes third-party rights;
• unlawful content;
• defamatory, threatening or discriminatory content;
• photographs or content used without the necessary rights or authorization;
• duplicate listings intended to manipulate search results or visibility;
• content containing malware or dangerous links;
• listings unrelated to the real estate purpose of the platform;
• content intended to circumvent Menzili's rules or systems.

Menzili may remove or disable any content that appears to violate these Terms or applicable laws and regulations.

8. Obligations of Agencies and Professionals

Agencies and professionals publishing on Menzili are responsible for the information relating to their business and the properties they offer.

They must, in particular:

• provide accurate professional information;
• not impersonate another agency or company;
• have the necessary rights or authorizations to publish the properties offered;
• keep their professional information up to date;
• deal fairly with people contacting them through Menzili.

The presence of an agency or professional on Menzili does not, by itself, constitute a certification or guarantee of their services by Menzili.

9. Accuracy of Real Estate Information

Menzili provides tools allowing Advertisers to present information about their properties.

However, Menzili does not guarantee the accuracy, completeness or timeliness of all information contained in listings.

Information relating in particular to:

• price;
• surface area;
• legal status;
• availability;
• location;
• property characteristics;
• photographs;
• sale or rental conditions;
• is the responsibility of the Advertiser.

Users must carry out their own checks before making any decision or entering into any transaction.

10. User Contact

Menzili may allow people interested in a listing to contact the Advertiser directly, including by telephone, WhatsApp, contact form or any other method offered on the platform.

Menzili does not guarantee that an Advertiser will respond to contact requests.

Menzili also does not guarantee that a transaction will be concluded between Users.

All negotiations, visits, reservations, sales, rentals, payments and contract signings take place directly between the parties concerned.

11. Transactions Between Users

Unless expressly stated otherwise, Menzili does not participate in transactions between Advertisers and interested persons.

Menzili does not guarantee, in particular:

• the solvency of a User;
• ownership of a property;
• the validity of a title deed;
• the legal or administrative status of a property;
• the absence of disputes relating to a property;
• the actual availability of a property;
• the completion of a transaction.

The parties are responsible for carrying out the necessary checks and, where appropriate, consulting qualified professionals.

12. Free and Paid Services

Menzili may offer various free or paid services to individuals and professionals.

The features, prices, durations and applicable conditions are presented when subscribing to the relevant service.

When a paid service is offered, the User is informed of the applicable price before confirming the subscription.

Menzili may modify its offers and prices for new subscriptions.

Specific terms applicable to a paid service may supplement these Terms.

13. Payments

When a paid service is available, payment is made using the payment methods offered by Menzili or its payment service providers.

The User agrees to provide accurate information required to process the payment.

Menzili does not necessarily store banking or payment information used by the User when such information is processed directly by a payment service provider.

In the event of a failed or cancelled payment, the relevant service may not be activated or may be suspended in accordance with the applicable conditions.

14. Listing and Account Moderation

Menzili may carry out checks and moderation of listings, accounts and content published on the platform.

Menzili may, in particular:

• request that a listing be modified;
• temporarily hide a listing;
• remove a listing;
• temporarily suspend an account;
• permanently disable an account;
• restrict certain features.

These measures may be taken in cases of violation of the Terms, fraudulent activity, unlawful content, repeated reports or risks to the security of the platform or its Users.

15. Reporting a Listing

Any User may report a listing or content that they believe violates these Terms or applicable laws and regulations.

Menzili may review the report and take any measures it considers appropriate based on the available information.

Submitting a report does not automatically result in the removal of the reported content.

16. Intellectual Property

The structure, design, graphic elements, logo, texts created by Menzili, features, software and other elements belonging to the platform are protected by applicable intellectual property laws.

Any unauthorized reproduction, representation, adaptation, extraction or exploitation of all or part of these elements is prohibited.

The Advertiser retains the rights they hold in relation to the content they publish.

By publishing content on Menzili, the Advertiser grants Menzili, to the extent necessary for operating the service, the right to host, reproduce, technically adapt, display and distribute such content on the platform and through the means necessary to promote it.

The Advertiser warrants that they have the necessary rights to the content they publish, including photographs, texts, logos and other elements.

17. Personal Data

Menzili may process certain personal data necessary to operate its services, including when creating an account, publishing a listing, contacting an Advertiser or using certain features.

Such processing is carried out in accordance with applicable Tunisian legislation relating to the protection of personal data, including Organic Law No. 2004-63 of July 27, 2004 on the Protection of Personal Data.

Detailed information regarding the data collected, the purposes of processing, retention periods and the rights of data subjects is provided in Menzili's Privacy Policy.

18. Cookies and Similar Technologies

Menzili may use cookies and similar technologies necessary for website operation, security, audience measurement, service improvement and, where applicable, certain advertising features.

The conditions governing the use of these technologies are described in Menzili's Privacy Policy or Cookie Policy.

19. Third-Party Links

Menzili may contain links or references to third-party websites, services or platforms.

Menzili is not responsible for the content, availability, practices or terms of use of such third-party services.

Use of a third-party service is subject to its own terms and conditions.

20. Availability and Security

The User agrees not to:

• disrupt the operation of the website;
• attempt unauthorized access to Menzili's systems;
• circumvent security measures;
• use robots or automated tools abusively;
• extract large quantities of platform data without authorization;
• introduce viruses or other malicious code;
• perform actions that may adversely affect the platform's performance.

Any abusive use may result in suspension or termination of the relevant account and, where applicable, any other action provided for by applicable law.

21. Menzili's Liability

Menzili uses reasonable efforts to ensure the operation and security of the platform.

However, Menzili cannot be held responsible, in particular, for:

• information published by Users;
• errors contained in listings;
• transactions concluded between Users;
• User behavior;
• temporary website unavailability;
• damage resulting from improper use of the services;
• content or services provided by third parties;
• interruptions or failures relating to networks or services independent of Menzili.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded.

22. Account Suspension or Closure

The User may request closure of their account in accordance with the methods provided by Menzili.

Menzili may suspend or close an account, in particular when:

• the User violates these Terms;
• the information provided is false or misleading;
• the account is used for fraudulent purposes;
• the User interferes with the operation or security of the platform;
• required by law or by a competent authority.

Closing an account does not necessarily terminate obligations that, by their nature, are intended to survive closure.

23. Removal of Listings

An Advertiser may delete or modify their listings using the available features.

Menzili may also remove or disable a listing when it no longer complies with the platform's rules or when the property is no longer available.

Menzili may retain certain data when necessary, including to comply with legal obligations, ensure platform security or prevent abuse.

24. Notifications and Communications

Menzili may send Users communications necessary for the operation of their account and the services they use.

These may include:

• confirmations;
• account alerts;
• listing notifications;
• security-related messages;
• information concerning the services used.

Commercial communications are subject to applicable rules and the User's choices where such options are available.

25. Applicable Law

These Terms are governed by Tunisian law, subject to any mandatory provisions that may apply.

In the event of a dispute relating to the use of Menzili, the parties are encouraged to seek an amicable solution first.

If no amicable solution can be reached, the dispute shall be submitted to the competent courts in accordance with applicable Tunisian law.

26. Changes to the Services

Menzili may develop, modify, suspend or discontinue certain platform features.

Such changes may include:

• listing publication features;
• search systems;
• agency profiles;
• listing promotion services;
• contact methods;
• free or paid offers.

Users will be informed of significant changes to the terms applicable to services where necessary.
